  • Subscription: Recurring paid access to premium features
  • Trial Period: Initial 7-day access period available for $1.00 (or local equivalent shown at checkout)
  • Standard Subscription: Recurring paid access following the trial period
  • Billing Cycle: The frequency of subscription charges (weekly, monthly, or quarterly)

2.2 Agreement to Terms

By accessing or using myIQup:

  • You agree to these Terms & Conditions

  • You acknowledge our service limitations and disclaimers

2.3 Access Methods

These Terms apply to all access methods, including:

3. IQ TESTING AND TRAINING DISCLAIMERS

3.1 Educational Entertainment Purpose

myIQup provides IQ testing and brain training services for educational and entertainment purposes only. You acknowledge:

  • Our services are not professional psychological tools
  • Tests are not equivalent to clinical IQ assessments
  • Results are for personal interest and entertainment
  • Scores should not be used for academic, professional, medical, or diagnostic purposes

3.2 Testing Limitations

Results:

  • May not reflect actual intelligence or cognitive ability
  • Can be influenced by factors such as environment, stress, time of day, device quality, and internet stability

3.3 Training Program Disclosure

You acknowledge that:

  • Content is based on general cognitive exercise principles
  • No guarantee of improvement is provided
  • Individual results vary significantly
  • Progress in games may not translate into real-world cognitive outcomes

3.4 Professional Advice Notice

We do not provide medical or psychological advice. For clinical assessment, consult licensed professionals.

3.5 User Responsibility

All use is at your own discretion and risk. We are not liable for decisions made based on results or outcomes associated with interpretation.

4. ACCEPTANCE OF TERMS

4.1 Agreement to Terms

By using the Service, you confirm you have read, understood, and agree to be bound by these Terms.

If you do not agree, you must not use the Service.

4.2 Modifications to Terms

We may modify these Terms at any time. Material changes will be communicated via the Platform and/or email.

Changes become effective:

  • For new users: immediately upon posting
  • For existing users: on the effective date stated in the notice (if notice is required)

Continued use constitutes acceptance.

5. ACCOUNT ELIGIBILITY AND SECURITY

5.1 Age Requirements

For security and efficiency, we may remove inactive accounts after 365 days of inactivity, unless retention is required by law or legitimate business needs (e.g., fraud prevention, billing disputes).

6. SUBSCRIPTION SERVICES

6.1 Subscription Options

Trial:

  • 7-day trial
  • One-time charge: $1.00 (or local equivalent shown at checkout)
  • Full premium access during trial
  • Converts to the selected plan after trial ends (unless canceled)

Standard Subscription:

  • Begins immediately after the trial ends
  • Charged at the rate shown during sign-up
  • Subscriptions auto-renew until canceled

6.2 Plans and Pricing

Base pricing may be listed in USD for reference, but you will always see the final local price (including applicable taxes/fees, if any) before purchase.

Plans may include weekly, monthly, and quarterly cycles. Final pricing is shown during checkout and is the amount you will be charged.

Trial split charge notice (if applicable):
Your $1 trial payment may appear as two separate charges (e.g., $0.50 + $0.50) depending on region/payment method. Total remains $1.

6.3 Billing and Payment

  • Payments processed via PCI DSS-compliant providers
  • Auto-renewal applies unless canceled before renewal
  • Failed payments may trigger retries for up to 30 days
  • Access may be suspended after prolonged failure to pay

6.4 Cancellation Process

You can cancel via:

  • Access continues until the current paid period ends
  • No further renewals occur
  • No partial refunds for unused time (unless required by law or explicitly stated in Section 7)

7. REFUND POLICY

7.1 Trial Refunds ($1.00)

Eligible for a full refund within 30 days if:

  • First-time trial user
  • No prior trial refunds on any account
  • No Terms violations
  • Request submitted via official channels

7.2 Regular Subscription Refunds

Refunds are generally not provided, except in these cases:

  • Service unavailability: verified downtime > 24 consecutive hours (excluding maintenance/force majeure)
  • Technical issues: verified bugs preventing core feature access, reported within 30 days
  • Billing errors: duplicate charges, incorrect amounts, unauthorized transactions
  • Legal requirements: where mandatory consumer laws apply

7.3 Non-Refundable Cases

Not eligible:

  • Partial/unused time after cancellation
  • Failure to cancel before renewal
  • Plan downgrades
  • Maintenance-related interruptions
  • Change of mind

7.4 Refund Process

7.5 Currency and Conversion

Exchange rates and conversion fees are determined by your bank/card issuer. Such fees are not controlled by us and are not refundable.

8. INTELLECTUAL PROPERTY RIGHTS

All Service content and functionality (including tests, UI, branding, and training content) are owned by Company or its licensors and are protected by applicable IP laws.

8.2 License to Users

We grant you a limited, personal, non-transferable, non-commercial license to use the Service as provided.

8.3 Prohibited Actions

You must not:

  • Reverse engineer or attempt to extract source code
  • Copy, reproduce, redistribute content without permission
  • Remove copyright/trademark notices
  • Create derivative works based on our Service/content

9. USER CONTENT AND RIGHTS

9.1 User Ownership

You retain ownership of content you submit (where applicable).

9.2 License to Us

You grant us a non-exclusive, worldwide, royalty-free license to host, process, display, and use your content solely to operate, maintain, and improve the Service, including for troubleshooting, analytics, and support.

9.3 Restrictions

You must not submit:

  • Illegal content
  • Malicious code
  • IP-infringing material
  • Deceptive or harmful information

10. SERVICE LEVEL AGREEMENT (SLA)

10.1 Availability

Target uptime: 97% annual availability, excluding:

  • Scheduled maintenance
  • Force majeure events
  • External provider outages beyond our control

10.2 Maintenance Windows

  • Scheduled maintenance: typically with advance notice when practical
  • Emergency maintenance: may occur immediately for security/stability reasons

10.3 Service Credits (Optional)

  • 95–97% uptime: 3-day credit
  • 90–95% uptime: 7-day credit
  • Below 90%: 14-day credit

Credits apply upon request and verification.

11. TECHNICAL REQUIREMENTS

Supported browsers and devices may include:

  • Chrome 90+
  • Firefox 88+
  • Safari 14+
  • Edge (Chromium) 90+

Minimum requirements:

  • Stable internet connection
  • JavaScript and cookies enabled
  • HTTPS supported
  • Modern web standards support

We may update requirements for security and performance reasons.

12. CUSTOMER SUPPORT AND COMPLAINTS

12.1 Support Availability

Support may be available 24/7/365, depending on operational capacity. We aim to respond as quickly as practical.

13. LIMITATION OF LIABILITY AND INDEMNIFICATION

To the maximum extent permitted by applicable law, our aggregate liability for claims related to the Service shall not exceed the amount you paid for the Service during the 12 months preceding the claim.

13.2 Excluded Damages

We are not liable for indirect or consequential damages, including:

  • Lost profits/revenue
  • Business interruption
  • Loss of data
  • Emotional distress
  • Decisions made based on results

13.3 Force Majeure

We are not liable for delays or failures caused by force majeure events.

13.4 Indemnification

You agree to indemnify and hold harmless Company from claims arising from:

  • Your violation of these Terms
  • Your misuse of the Service
  • Your infringement of third-party rights
  • Your unlawful content/actions

14. DISPUTE RESOLUTION AND GOVERNING LAW

Before filing any claim, you agree to contact us at support@myiqup.com and attempt informal resolution.

14.2 Governing Law

These Terms are governed by the laws of the United Arab Emirates, as applicable in the Emirate of Dubai, unless mandatory consumer laws of your jurisdiction require otherwise.

14.3 Jurisdiction

Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the competent courts of Dubai, United Arab Emirates, unless mandatory consumer protection rules provide otherwise.

15. SERVICE MODIFICATIONS

We may modify, suspend, or discontinue any part of the Service:

  • With notice where practical for material changes
  • Immediately for security, legal compliance, or emergency stability reasons

Continued use after changes constitutes acceptance.

16. ACCOUNT TERMINATION

16.1 User Termination

You may terminate/cancel via:

  • Effective immediately for account access (subscription access continues until period end unless otherwise required)
  • No refunds for unused time except as described in Section 7 or required by law

16.2 Termination by Us

We may suspend or terminate accounts for:

  • Terms violations
  • Fraud or abusive behavior
  • Security threats
  • Payment defaults
  • Legal/regulatory requirements
  • Age violations

16.3 Post-Termination Data Handling

Data handling follows our Privacy Policy and applicable laws.
